Agreement to Terms

By accessing or using Quantum Scaling ("the Service"), operated by Viral Wizard LLC ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Description of Service

Quantum Scaling is an AI clone agency that builds and deploys AI clone systems for personal brands and businesses. Our services include done-for-you AI clone production, custom system installations, consulting, and related AI content services. The Service is delivered through our website at quantumscaling.ai and through direct client engagements.

Service Engagements

Quantum Scaling offers multiple service tiers including monthly retainer engagements and fixed-scope system installations. Each engagement is governed by a separate Professional Services Agreement or Cloud Service Agreement that details the specific scope, deliverables, timeline, and fees. In the event of a conflict between these Terms and a signed service agreement, the service agreement controls.

Accounts and Access

• You must be at least 18 years old to engage our services
• You are responsible for maintaining the security of any account credentials we provide
• You may not share access to client portals or tools unless explicitly permitted
• We reserve the right to suspend or terminate access for violations of these terms

Payments and Billing

• Service fees are outlined in your engagement agreement
• All prices are in USD unless otherwise specified
• Retainer payments are due at the start of each billing period
• Late payments may result in service suspension after 30 days
• You are responsible for any applicable taxes

Intellectual Property

• Content produced by our AI clone systems on your behalf belongs to you — we claim no ownership of your output
• Our proprietary systems, software, processes, templates, and methodologies remain our intellectual property
• Your engagement grants you a license to use the delivered system for your business — not to resell, redistribute, or white-label it
• Brand assets, voice data, and likeness data you provide remain your property

AI-Generated Content

Quantum Scaling uses AI technologies including voice cloning, video avatars, language models, and content generation tools. You acknowledge that:

• AI clones will only be created of individuals who have given explicit, documented consent
• You are responsible for reviewing and approving all AI-generated content before publication
• You will comply with applicable laws and platform terms of service when publishing AI-generated content
• AI outputs may occasionally contain errors — final review responsibility rests with you
• We use third-party AI providers whose capabilities and terms may change over time

Third-Party Services

Our service integrates with third-party AI providers, APIs, and platforms. We are not responsible for the availability, accuracy, or policies of third-party services. Changes to third-party services may affect functionality. Current providers and their terms are disclosed in your service agreement.

Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. This includes business strategies, financial data, client lists, trade secrets, and technical implementations. Confidentiality obligations survive termination of the engagement. Specific confidentiality terms may be detailed in a separate NDA or service agreement.

Data Usage and AI Training

• Your brand data (voice, likeness, content) is used exclusively to deliver your contracted services
• We do not use your data to train AI models for other clients without explicit written consent
• Aggregated, anonymized usage data may be used to improve our internal processes
• Specific data handling terms are outlined in your service agreement and any applicable AI Addendum

Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service or any AI-generated content. Our total liability is limited to the amount you paid for services in the 12 months preceding the claim. Specific liability terms may be detailed in your service agreement.

Disclaimer

Results vary. We do not guarantee specific outcomes, revenue, engagement metrics, or growth from using our services. Success depends on many factors including your brand, audience, market conditions, and how you deploy the content. Case studies and testimonials represent individual results and are not guarantees.

Termination

• Either party may terminate a retainer engagement with 30 days written notice
• We may terminate immediately for material breach, non-payment, or misuse of AI-generated content
• Upon termination, you retain ownership of all content produced during the engagement
• System access and credentials will be transferred or revoked per the terms of your service agreement

Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via email.

Governing Law

These terms are governed by the laws of the State of Florida, United States. Any disputes will be resolved in the courts of Florida.
